if we have better sprint on and we don't use it are we banned too? or only if we use it

If you're using it on our servers then yes, you will be banned. As long as you're not using it whilst you're playing on our servers then you won't get banned for it.

Remove it if you believe you may accidentally enable it.

If you really think that you may turn it on in game, have a separate .jar file that is un-modded, or, simply remove the mod.
